1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and GoCanadaSearch / GoSocial ("we", "us", "our", or the "Platform").
By visiting our website at gocanadasearch.ca, downloading or using the GoSocial mobile application (iOS or Android), registering an account, or interacting with any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our incorporated Privacy Policy.
If you do not agree with any part of these Terms, you must not access or use the GoCanadaSearch website or GoSocial applications.
2. User Accounts and Eligibility
Eligibility
You must be at least 13 years old (or the legal age of digital consent in your jurisdiction) to use our services. If you are under the age of majority in your province or territory of residence, you represent that you have received parental or guardian permission to use the platform.
Account Registration & Security
GoCanada ID: You may create a unified account using your email address, phone number, and a secure password.
Truthful Information: You agree to provide true, accurate, current, and complete information during registration and keep profile details updated.
Account Confidentiality: You are solely responsible for maintaining the confidentiality of your credentials (including login password and one-time password OTP codes). You agree to notify us immediately at support@gocanadasearch.ca of any unauthorized access.
Individual Accounts: One account is permitted per person. Impersonating any individual or entity, creating fake profiles, or using another person's account without express permission is strictly prohibited.
3. GoSocial Posts, Photos, Videos, Reels and User Content
GoSocial enables community members to share ideas, create text posts, upload photos, share short video clips and reels, publish stories, and comment on discussions.
Ownership of Your Content
You retain full ownership of and copyright to any original content, photos, videos, audio, text, or reels that you submit, upload, or display on GoSocial.
License Granted to the Platform
By submitting or posting content on GoSocial, you grant us a worldwide, non-exclusive, royalty-free, transferable license (with the right to sublicense) to host, store, cache, display, reproduce, format, and distribute your content across our platform solely for the purpose of operating, developing, providing, and promoting GoCanadaSearch and GoSocial services.
User Warranties for Uploaded Content
You warrant that you own or have obtained all necessary rights, licenses, consents, and permissions to upload and share your content, and that your content does not violate any third-party intellectual property, privacy, or publicity rights.
4. Business Listings and Business Claims
GoCanadaSearch offers a comprehensive Canadian business directory connecting consumers with local enterprises, service providers, and professionals.
Adding Listings: Business owners or authorized agents may add local businesses to the directory with accurate names, addresses, descriptions, categories, opening hours, and contact details.
Business Verification & Claiming: When claiming an existing business profile, you represent and warrant that you are the lawful owner or an authorized representative with authority to manage the business listing. We reserve the right to require documentation to verify ownership.
Accuracy & Integrity: Businesses must provide truthful, non-misleading information regarding services, pricing, and credentials. Fraudulent, deceptive, or unauthorized business claims will result in immediate profile suspension and listing removal.
5. Reviews and Comments
Consumers may submit ratings, reviews, and comments on business profiles, community discussions, and service pages.
Authentic Experiences: Reviews must be based on genuine, firsthand customer experiences with the business or service.
Prohibited Review Practices: Writing fraudulent or paid reviews, reviewing your own business or a competitor's business for anticompetitive purposes, or using reviews for extortion or harassment is strictly prohibited.
Platform Discretion: We do not verify every review before publication, but we reserve the right to remove any review that violates our content guidelines or exhibits characteristics of automated spam or abuse.
6. Jobs, Housing and Marketplace Listings
GoCanadaSearch facilitates local community classifieds, including employment opportunities, rental housing (available and wanted), and community classified advertisements.
Compliance with Canadian Laws
All job postings and housing advertisements must comply fully with Canadian federal, provincial, and municipal laws, including the Ontario Human Rights Code, the Employment Standards Act, the Residential Tenancies Act, and applicable fair housing standards. Discriminatory preferences based on race, ancestry, place of origin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, gender identity, age, marital status, family status, or disability are strictly forbidden.
Safety & Intermediary Status
Important Marketplace Notice: GoCanadaSearch acts solely as an informational directory and neutral venue. We are not an employer, landlord, broker, real estate agent, or party to any transaction. Users must exercise independent due diligence before sending funds, signing rental leases, or accepting employment offers. Never transfer money, deposits, or sensitive identity documents to unverified parties.
7. Prohibited Content and User Conduct
You agree not to engage in any prohibited activity or publish prohibited content on GoCanadaSearch or GoSocial. Prohibited actions include:
Hate Speech & Harassment: Content that promotes violence, incites hatred, discriminates against, defames, bullies, stalks, or threatens any individual or protected group.
Sexually Explicit or Inappropriate Content: Nudity, pornography, sexually explicit media, or any content exploiting or endangering minors.
Unlawful Activity: Promoting illegal substances, weapons, fraudulent schemes, counterfeit goods, or criminal conduct under Canadian law.
Intellectual Property Infringement: Uploading copyrighted media, trademarks, or proprietary material without explicit authorization.
System Abuse: Attempting to reverse engineer, scrape, crawl, bypass rate limits, inject malicious code (viruses, trojans), or interfere with platform servers and infrastructure.
8. Intellectual Property Rights
All software, user interfaces, branding, logos, trademarks, database designs, icons, graphics, and text created by GoCanadaSearch and GoSocial are the proprietary intellectual property of the platform and its licensors, protected under Canadian and international copyright and trademark laws.
You may not copy, modify, distribute, sell, reverse engineer, or create derivative works of any part of our platform without our express prior written permission.
Copyright Infringement Notices
We respect the intellectual property rights of others. If you believe your copyrighted work has been infringed on our platform, please send a written notice to terms@gocanadasearch.ca containing: (a) description of the copyrighted work, (b) URL/location of the infringing material, and (c) your contact information and statement of good faith belief.
9. Content Moderation, Suspension and Account Termination
We are dedicated to maintaining a safe, respectful, and productive community for all Canadians.
Right to Moderate: We reserve the right, but assume no obligation, to monitor, review, edit, reject, hide, or remove any user-generated post, business listing, review, photo, video, or comment at our sole discretion.
Suspension & Termination: We may suspend, deactivate, or permanently terminate your account and access to GoSocial and GoCanadaSearch immediately, without prior notice or liability, if you violate these Terms, engage in unlawful activities, or pose a risk to the security and integrity of our community.
Voluntary Account Deletion: You may close your account at any time through your Account Settings or by contacting privacy@gocanadasearch.ca.
10. Third-Party Services and Links
Our platform may contain links to external third-party websites, businesses, booking portals, payment processors, or external service providers that are not owned or controlled by GoCanadaSearch.
We do not endorse, guarantee, or assume responsibility for the content, privacy policies, products, or practices of any third-party websites. When accessing external sites, you do so entirely at your own risk and subject to the terms and privacy conditions of those third parties.
11. Disclaimer of Warranties
"AS IS" AND "AS AVAILABLE" BASIS:
To the fullest extent permitted by applicable Canadian law, GoCanadaSearch and GoSocial are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise.
We expressly disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, non-infringement, and any warranties arising out of course of dealing or usage of trade.
We do not warrant that the platform will meet your requirements, be uninterrupted, timely, secure, or error-free, or that information obtained through the platform will be accurate, complete, or reliable.
12. Limitation of Liability
To the maximum extent permitted by applicable law in the Province of Ontario and Canada, in no event shall GoCanadaSearch, GoSocial, its founders, directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, business interruption, or other intangible losses, resulting from:
Your access to or use of, or inability to access or use, the platform;
Any conduct or content of any third party on the platform, including defamatory, offensive, or illegal conduct;
Any content obtained from the platform; or
Unauthorized access, use, or alteration of your transmissions, content, or account.
13. Indemnification
You agree to defend, indemnify, and hold harmless GoCanadaSearch, GoSocial, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with:
Your access to or use of the GoCanadaSearch platform or GoSocial applications;
Your user content, posts, photos, videos, reels, reviews, or business claims;
Your violation of any provision of these Terms or applicable Canadian laws; or
Your violation of any rights of a third party, including intellectual property or privacy rights.
14. Privacy Policy Reference
Your privacy is of utmost importance to us. Our data practices regarding collection, use, precise location permissions, user media, and account/data deletion are detailed in our dedicated Privacy Policy.
By agreeing to these Terms of Service, you also acknowledge and agree to the collection and handling of your information as outlined in the Privacy Policy.
15. Changes to Terms
We reserve the right, at our sole discretion, to modify, amend, or replace these Terms at any time. When updates occur, we will update the "Effective Date" and "Last Updated" date at the top of this document.
Material revisions will be posted on https://gocanadasearch.ca/terms. Your continued access or use of GoCanadaSearch or GoSocial following the posting of any revised Terms constitutes your unconditional acceptance of such changes.
16. Governing Law (Ontario, Canada)
These Terms, your use of the platform, and any dispute or claim arising out of or related to these Terms or GoCanadaSearch / GoSocial shall be governed by, construed, and enforced in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree to submit to the exclusive personal jurisdiction of the provincial and federal courts located in Ontario, Canada to resolve any legal matter or litigation arising from these Terms or our services.
